class=\"fusion-text fusion-text-2\"><h1>La importancia del silencio administrativo positivo en la inscripci\u00f3n y el registro del Plan de Igualdad<\/h1>\n<\/div><div class=\"fusion-separator fusion-full-width-sep\" style=\"align-self: center;margin-left: auto;margin-right: auto;margin-top:20px;width:100%;\"><\/div><div class=\"fusion-text fusion-text-3\"><p>El pasado 11 de abril de 2024, el Tribunal Supremo (Sala de lo Social, Pleno) dict\u00f3 la Sentencia n.\u00ba 543\/2024, mediante la cual analiz\u00f3 los efectos del silencio administrativo en aquellos casos en que una entidad solicita la inscripci\u00f3n y el registro de su Plan de Igualdad en el Registro y Dep\u00f3sito de Convenios Colectivos, Acuerdos Colectivos de Trabajo y Planes de Igualdad (en adelante, \u201cREGCON\u201d).<\/p>\n<p>Por lo que respecta al caso analizado, debe destacarse que, tras la negociaci\u00f3n y aprobaci\u00f3n de su Plan de Igualdad, una entidad trat\u00f3 de inscribirlo en el REGCON.<\/p>\n<p>Tras examinar dicho plan, la Direcci\u00f3n General de Trabajo realiz\u00f3 un requerimiento para la subsanaci\u00f3n de ciertos defectos. Sin embargo, pese a que la entidad subsanara los mismos, la Direcci\u00f3n General de Trabajo no ofreci\u00f3 respuesta alguna durante un plazo de tres (3) meses, motivo por el cual la entidad solicit\u00f3 la expedici\u00f3n del certificado del silencio administrativo estimatorio. Pese a ello, se dict\u00f3 resoluci\u00f3n por la que desestim\u00f3 la inscripci\u00f3n del Plan de Igualdad en el REGCON.<\/p>\n<p>Al analizar dicho supuesto, el Tribunal Supremo concluy\u00f3 que, <strong>transcurrido el plazo de tres (3) meses previsto en los art\u00edculos 21 y 24 de la Ley 39\/2015, de 1 de octubre, del Procedimiento Administrativo Com\u00fan de las Administraciones P\u00fablicas, debe operar el silencio administrativo positivo. Del mismo modo destac\u00f3 que una resoluci\u00f3n expresa posterior \u00fanicamente podr\u00eda ser confirmatoria de la inscripci\u00f3n y registro de dicho plan.<\/strong><\/p>\n<p>Por tanto, en aquellos casos en que se solicite la inscripci\u00f3n de un Plan de Igualdad en el REGCON y la Administraci\u00f3n no ofrezca respuesta alguna durante un plazo de tres (3) meses, operar\u00e1 el silencio administrativo positivo, <strong>debi\u00e9ndose proceder a la inscripci\u00f3n y el registro de dicho plan<\/strong>.<\/p>\n<\/div><div class=\"fusion-text fusion-text-4\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-0 fusion_builder_column_3_4 3_4 fusion-flex-column\">\n<div class=\"fusion-column-wrapper fusion-column-has-shadow
