auto;margin-right: auto;margin-top:20px;width:100%;\"><\/div><div class=\"fusion-text fusion-text-4\"><p>Mediante este\u00a0<strong>Criterio de Gesti\u00f3n 5\/2024<\/strong>, de 8 de marzo de 2024, del\u00a0<strong>Instituto Nacional de la Seguridad Social<\/strong>, se trata sobre el reconocimiento a los hombres del complemento por maternidad por aportaci\u00f3n demogr\u00e1fica previsto en el art\u00edculo 60 del texto refundido de la Ley General de la Seguridad Social, aprobado por Real Decreto-legislativo 8\/2015, de 30 de octubre (TRLGSS), en la redacci\u00f3n original dada por el TRLGSS.<\/p>\n<p>Con fecha 21 de febrero de 2024 el\u00a0<strong>Tribunal Supremo<\/strong>\u00a0ha dictado la sentencia para la unificaci\u00f3n de doctrina n\u00fam.322\/2024, rcud.862\/2023, que se pronuncia sobre la prescripci\u00f3n del complemento por maternidad. Considera el Tribunal Supremo que el complemento por maternidad no es aut\u00f3nomo, sino que act\u00faa de manera accesoria a la pensi\u00f3n contributiva a la que complementa. En consecuencia, no constituye una pretensi\u00f3n independiente de la solicitada en el momento en que se pide la pensi\u00f3n, sino que estaba \u00ednsita en la acci\u00f3n ejercitada para solicitar la prestaci\u00f3n a la que complementa. Ello significa que\u00a0una vez reconocida la pensi\u00f3n contributiva que complementa, el complemento por maternidad no prescribe, y ha de reconocerse con los mismos efectos econ\u00f3micos que los del reconocimiento inicial de dicha pensi\u00f3n.<\/p>\n<p>De acuerdo con la citada sentencia, y teniendo en cuenta la doctrina que sobre el reconocimiento del complemento por maternidad a los hombres ha sido anteriormente dictada por el Alto Tribunal, se compilan en este criterio las pautas de actuaci\u00f3n:<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<h2><strong>1. Car\u00e1cter no unitario.<\/strong><\/h2>\n<p>Proceder\u00e1 reconocer el complemento por maternidad al padre que re\u00fana los requisitos necesarios para percibirlo, aun cuando se hubiese reconocido previamente a la madre por los mismos hijos. Este reconocimiento del complemento al padre no puede conllevar reducci\u00f3n alguna del complemento por maternidad que viniera percibiendo la madre.<\/p>\n<h2><strong>2. Imprescriptibilidad. Efectos econ\u00f3micos.<\/strong><\/h2>\n<p>La naturaleza jur\u00eddica del complemento por maternidad es la misma que la pensi\u00f3n a la que complementa, por lo que el derecho al complemento ser\u00e1 imprescriptible si el derecho a la pensi\u00f3n tambi\u00e9n lo es.<\/p>\n<p>No obstante, una vez reconocida la pensi\u00f3n, el derecho al complemento deviene en todo caso en imprescriptible. El reconocimiento del derecho al complemento por maternidad se retrotraer\u00e1 a la fecha en la que se haya reconocido la pensi\u00f3n a la que complementa, con los mismos efectos econ\u00f3micos que esta.<\/p>\n<h2><strong>3. Agravamiento o mejor\u00eda del grado de incapacidad permanente inicialmente reconocido.<\/strong><\/h2>\n<p>En los supuestos de revisi\u00f3n por agravamiento o mejor\u00eda del grado de incapacidad permanente inicialmente reconocido, la fecha que habr\u00e1 de considerarse para determinar si procede reconocer el complemento por maternidad ser\u00e1 la del reconocimiento inicial, de forma que solo se reconocer\u00e1 el citado complemento si el reconocimiento inicial de la pensi\u00f3n de incapacidad permanente se produjo despu\u00e9s de 1 de enero de 2016. La fecha del reconocimiento inicial ser\u00e1 tambi\u00e9n la que se tenga en cuenta para establecer los efectos del complemento por maternidad, si procediera.<\/p>\n<h2><strong>4. Concurrencia con el complemento de pensiones contributivas para la reducci\u00f3n de la brecha de g\u00e9nero (CRBG) que pudiera tener reconocido el padre por otra pensi\u00f3n.<\/strong><\/h2>\n<p>Conforme al segundo p\u00e1rrafo de la\u00a0<a href=\"https:\/\/etl.es\/criterio-del-inss-sobre-el-complemento-por-maternidad-para-hombres-por-aportacion-demografica\/Redirection('LE0000561511_Vigente.html#I10451')\">disposici\u00f3n transitoria trig\u00e9sima tercera del TRLGSS<\/a>, la percepci\u00f3n del complemento por maternidad ser\u00e1 incompatible con el CRBG que pudiera corresponder al mismo interesado por el reconocimiento de una nueva pensi\u00f3n p\u00fablica, debiendo optar entre uno u otro complemento.<\/p>\n<p>Por tanto, si el padre viniese disfrutando del CRBG por raz\u00f3n de una pensi\u00f3n y, con motivo de la nueva doctrina optase por el reconocimiento del complemento por maternidad por raz\u00f3n de otra pensi\u00f3n distinta, se descontar\u00e1 del complemento por maternidad lo percibido por raz\u00f3n del CRBG durante el tiempo en el que ambos complementos se solapen.<\/p>\n<p><em>*CIRCULAR ETL<\/em><\/p>\n<\/div><\/div><\/div><div class=\"fusion-layout-column fusion_builder_column
