Obligaciones laborales para todas las empresas<\/strong><\/h2>\n<p><strong>Registro horario y Control de la jornada<\/strong><\/p>\n<p>Conforme a lo establecido en los art\u00edculos 34.9 y 12.4 del RD Legislativo 2\/2015, de 23 de octubre, que aprueba el texto refundido de la Ley del Estatuto de los Trabajadores, las empresas tienen la\u00a0<strong>obligaci\u00f3n de asegurar el registro horario de la jornada de su plantilla<\/strong>.<\/p>\n<p>Las\u00a0<strong>sanciones por no contar con Registro Horario<\/strong>\u00a0en la empresa van desde 751 euros a 225.018 euros.<\/p>\n<p>En cuanto a la implantaci\u00f3n y vigencia de la misma, debe renovarse\u00a0<strong>anualmente<\/strong>.<\/p>\n<p><strong>1.1 Registro Retributivo o Salarial<\/strong><\/p>\n<p>Seg\u00fan el RD 902\/2020, de 13 de octubre, todas las empresas deben\u00a0<strong>contar con un registro salarial para identificar posibles disparidades salariales entre ambos g\u00e9neros<\/strong>.<\/p>\n<p>Las sanciones por no contar con Registro Retributivo en la empresa, al igual que en el caso anterior, van\u00a0<strong>desde 751 euros a 225.018 euros<\/strong>.<\/p>\n<p>La vigencia del registro, debe renovarse\u00a0<strong>anualmente<\/strong>.<\/p>\n<p><strong>1.2 Protocolo de acoso en la empresa<\/strong><\/p>\n<p>Todas las empresas, sin importar su tama\u00f1o, deben\u00a0<strong>implementar un protocolo de acoso<\/strong>, con el fin de prevenir y eliminar conductas de acoso moral, sexual y por raz\u00f3n de sexo.<\/p>\n<p>Las\u00a0<strong>sanciones por no contar con Protocolo de acoso en la empresa<\/strong>\u00a0van desde 7.501 euros a 225.018 euros.<\/p>\n<p>Cuenta con\u00a0<strong>vigencia permanente<\/strong>, por lo que \u00fanicamente deber\u00e1 desarrollarse e implantarse una vez.<\/p>\n<p><strong>1.3 Plan de Prevenci<\/strong><strong>\u00f3<\/strong><strong>n de Riesgos Laborales<\/strong><\/p>\n<p>Las empresas tienen la responsabilidad de\u00a0<strong>garantizar la Seguridad Laboral de sus empleados<\/strong>, incorporando medidas preventivas y adoptando las acciones necesarias para mantener un entorno laboral sin riesgos ni accidentes.<\/p>\n<p><strong>1.4 Formaci<\/strong><strong>\u00f3<\/strong><strong>n en la empresa<\/strong><\/p>\n<p>Las empresas que cuentan con empleados a su cargo tienen asignado un\u00a0<strong>cr\u00e9dito formativo anual<\/strong>, determinado por las cotizaciones a la SS del a\u00f1o anterior, con un m\u00ednimo de 420\u20ac al a\u00f1o.<\/p>\n<p><strong>1.5 Seguro de convenio colectivo obligatorio<\/strong><\/p>\n<p>Otra de las obligaciones laborales que afectan a todas las empresas es el seguro de convenio colectivo. Este seguro brinda\u00a0<strong>cobertura a los accidentes que un trabajador pueda experimentar durante el ejercicio de sus funciones<\/strong>\u00a0laborales. En caso de fallecimiento o invalidez como resultado de un accidente, la compa\u00f1\u00eda aseguradora otorgar\u00e1 una compensaci\u00f3n al trabajador.<\/p>\n<p><strong>1.6 Calendario laboral anual<\/strong><\/p>\n<p>Seg\u00fan establece el Estatuto de los Trabajadores, las empresas est\u00e1n obligadas a elaborar un\u00a0<strong>calendario laboral anual y exponerlo en un lugar visible del centro de trabajo<\/strong>. Este incluir\u00e1 los\u00a0d\u00edas laborales y los d\u00edas festivos.<\/p>\n<p><strong>1.7 Acuerdo de teletrabajo<\/strong><\/p>\n<p>El Gobierno obliga a\u00a0<strong>firmar un acuerdo de teletrabajo a todas las compa\u00f1\u00edas que quieran impulsar el trabajo a distancia total o parcialmente<\/strong>. En caso de que no se firme el acuerdo, podr\u00eda implicar multas de entre 7.500 y 225.000 euros.<\/p>\n<\/div><div class=\"fusion-separator fusion-full-width-sep\" style=\"align-self: center;margin-left: auto;margin-right: auto;margin-top:25px;width:100%;\"><\/div><div class=\"fusion-text fusion-text-5\"><h2><strong>2. Obligaciones laborales para empresas de m\u00e1s de 50 trabajadores en plantilla<\/strong><\/h2>\n<h3><strong>2.1 Plan de igualdad en la empresa<\/strong><\/h3>\n<p><strong>Desde marzo de 2022<\/strong>, todas las empresas con 50 o m\u00e1s empleados est\u00e1n obligadas a\u00a0<strong>implementar un Plan de Igualdad y registrarlo p\u00fablicamente<\/strong>.<\/p>\n<p>Las\u00a0<strong>sanciones<\/strong>\u00a0por no contar con un plan de igualdad en la empresa var\u00edan\u00a0<strong>desde 751 euros hasta 225.018 euros.<\/strong><\/p>\n<p>Su vigencia es\u00a0<strong>permanente<\/strong>, revisable cada 4 a\u00f1os.<\/p>\n<h3><strong>2.2 Auditor<\/strong><strong>\u00ed<\/strong><strong>a Retributiva<\/strong><\/h3>\n<p>La Auditor\u00eda Retributiva consiste en un\u00a0<strong>an\u00e1lisis del sistema salarial de la empresa<\/strong>\u00a0con el objetivo de obtener la informaci\u00f3n necesaria para comprobar si el sistema retributivo de la organizaci\u00f3n, de manera transversal y completa, cumple con el principio de\u00a0igualdad entre mujeres y hombres en materia retributiva.<\/p>\n<p>Un incumplimiento formal de las obligaciones respecto a la\u00a0Igualdad Retributiva, puede ser considerado como una\u00a0<strong>infracci\u00f3n leve, grave o muy grave<\/strong>\u00a0de las relaciones laborales, seg\u00fan se recoge en la LISOS (Ley sobre Infracciones y Sanciones en el Orden Social), en funci\u00f3n de la gravedad de los hechos.\u00a0Las sanciones por no contar con la auditor\u00eda retributiva en la empresa var\u00edan\u00a0<strong>desde 751 euros hasta 225.018 euros<\/strong>.<\/p>\n<p>Su\u00a0<strong>vigencia es permanente<\/strong>, revisable cada 4 a\u00f1os.<\/p>\n<h3><strong>2.3 Protocolo de acoso LGTBI<\/strong><\/h3>\n<p><strong>Desde el 1 de marzo de 2024<\/strong>, las empresas de m\u00e1s de 50 trabajadores deber\u00e1n\u00a0<strong>contar con un Plan LGTBI<\/strong>, que incluir\u00e1 un conjunto de medidas y recursos para alcanzar la igualdad real y efectiva de las personas LGTBI, erradicando situaciones de discriminaci\u00f3n.<\/p>\n<p>Las\u00a0<strong>sanciones por no contar con un protocolo de acoso del colectivo LGTBI var\u00edan desde 200 euros hasta 150.000 euros.<\/strong><\/p>\n<p>Su\u00a0<strong>vigencia es permanente<\/strong>, por lo que \u00fanicamente deber\u00e1 desarrollarse e implantarse una vez.<\/p>\n<h3><strong>2.4 Canal de Denuncias<\/strong><\/h3>\n<p>Las empresas de m\u00e1s de 50 empleados deben contar con un\u00a0<strong>Canal de Denuncias<\/strong>\u00a0que proporcione al personal un medio seguro y confidencial para informar sobre fraudes, abusos, o cualquier comportamiento contrario a la \u00e9tica en el \u00e1mbito laboral.<\/p>\n<p>Las\u00a0<strong>sanciones<\/strong>\u00a0por no contar con un canal de denuncias var\u00edan\u00a0<strong>desde 100.000 euros hasta 1.000.000 euros<\/strong>.<\/p>\n<p>Su\u00a0<strong>vigencia es permanente<\/strong>, por lo que \u00fanicamente deber\u00e1 desarrollarse e implantarse una vez.<\/p>\n<h3><strong>2.5 Protocolo de desconexi<\/strong><strong>\u00f3<\/strong><strong>n digital<\/strong><\/h3>\n<p>Un protocolo de desconexi\u00f3n digital es un documento en el que se recogen la pol\u00edtica interna y las medidas tomadas por la empresa para garantizar el derecho a la desconexi\u00f3n digital de todos sus empleados (presenciales, a distancia, a jornada completa, a jornada parcial, incluidos directivos).<\/p>\n<p>Las\u00a0<strong>sanciones por no contar con un protocolo de desconexi\u00f3n digital var\u00edan desde 751 euros hasta 7.500 euros<\/strong>. Sin embargo,<strong>\u00a0pueden alcanzar hasta los 984.000 euros<\/strong>\u00a0por falta de medidas preventivas<\/p>\n<p>Su vigencia es\u00a0<strong>permanente<\/strong>, por lo que \u00fanicamente deber\u00e1 desarrollarse e implantarse una vez.<\/p>\n<h3><strong>2.6 Cuota de reserva de puestos de trabajo para personas con discapacidad<\/strong><\/h3>\n<p>Las empresas con una plantilla de 50 o m\u00e1s empleados tienen la responsabilidad de garantizar que\u00a0<strong>al menos el 2% de su personal posea el certificado de discapacidad<\/strong>, con un nivel de discapacidad igual o superior
