Esta ley tiene por objeto <strong>garantizar y promover el derecho a la igualdad real y efectiva de las personas lesbianas, gais, trans, bisexuales e intersexuales<\/strong> (en adelante, LGTBI), as\u00ed como de sus familias.<\/p>\n<p>Esta norma es de aplicaci\u00f3n para <strong>toda<\/strong> <strong>persona f\u00edsica o jur\u00eddica<\/strong>, de car\u00e1cter p\u00fablico o privado, que resida, se encuentre o act\u00fae en territorio espa\u00f1ol.<\/p>\n<p>La Ley 4\/2023 ha introducido una serie de obligaciones para determinadas entidades, concretamente para aquellas de <strong>m\u00e1s de 50 personas trabajadoras.<\/strong> En virtud del art\u00edculo 15 de la referida ley, se establece que dichas entidades deber\u00e1n contar, en el plazo de doce meses a partir de la entrada en vigor de la presente ley (<strong>02 de marzo de 2024<\/strong>), con un conjunto planificado de medidas y recursos para alcanzar la igualdad real y efectiva de las personas LGTBI, que incluya un <strong>protocolo de actuaci\u00f3n<\/strong> para la atenci\u00f3n del acoso o la violencia contra las personas LGTBI.<\/p>\n<p>La implantaci\u00f3n de dichas medidas y recursos para garantizar la igualdad de las personas LGTBI (ej.: confecci\u00f3n del protocolo de actuaci\u00f3n ante casos de acoso contra personas LGTBI) deber\u00e1 llevarse a cabo juntamente con la <strong>representaci\u00f3n legal de las personas trabajadoras<\/strong> (comit\u00e9 de empresa o delegados\/as de personal), debiendo los mismos contribuir en la prevenci\u00f3n de cualquier situaci\u00f3n de acoso en la organizaci\u00f3n.<\/p>\n<p>No obstante, el contenido y alcance de estas medidas se desarrollar\u00e1n reglamentariamente, por lo que habr\u00e1 que esperar al desarrollo reglamentario para conocer las medidas a implantar y poder incluir dichas medidas en el Plan de Igualdad que tenga cada entidad.<\/p>\n<p>En caso de no cumplir con la obligaci\u00f3n anteriormente mencionada, la propia ley recoge las sanciones a aplicar ante el incumplimiento de su articulado, con sanciones que van desde un apercibimiento a multas que pueden llegar a los <strong>150.000 euros<\/strong>, as\u00ed como a la <strong>imposici\u00f3n de medidas accesorias<\/strong> que son: la denegaci\u00f3n de subvenciones que hubiese optado o se hubiese reconocido a las entidades, la prohibici\u00f3n de acceder a cualquier ayuda p\u00fablica durante un per\u00edodo de hasta tres a\u00f1os, la prohibici\u00f3n de contratar con la Administraci\u00f3n P\u00fablica de hasta tres a\u00f1os, el cierre del establecimiento en que se haya producido la discriminaci\u00f3n por un t\u00e9rmino m\u00e1ximo de tres a\u00f1os y el cese en la actividad econ\u00f3mica o profesional desarrollada por un t\u00e9rmino m\u00e1ximo de tres a\u00f1os.<\/p>\n<p>Adem\u00e1s, las entidades que no cumplan con dichas obligaciones podr\u00e1n incurrir en sanciones tipificadas en otras normativas de aplicaci\u00f3n como, por ejemplo, las establecidas en la Ley de Infracciones y Sanciones en el Orden Social (LISOS).<\/p>\n<\/div><div class=\"fusion-separator fusion-full-width-sep\" style=\"align-self: center;margin-left: auto;margin-right: auto;margin-top:5px;width:100%;\"><\/div><div class=\"fusion-text fusion-text-2\"><p style=\"text-align: left;\">\u00a9 La presente
