un Plan de Igualdad con una Comisi\u00f3n ad hoc?<\/h1>\n<p>En anteriores circulares (<a href=\"https:\/\/www.escura.com\/es\/los-sindicatos-tendran-legitimidad-para-negociar-los-planes-de-igualdad\/\">Consulta circular<\/a>) hemos destacado que aquellas entidades que no disponen de representaci\u00f3n legal de las personas trabajadoras (comit\u00e9 de empresa o delegados\/as de personal) y tienen obligaci\u00f3n de llevar a cabo un Plan de Igualdad, deben ponerse en contacto con los sindicatos m\u00e1s representativos y con legitimizaci\u00f3n para llevar a cabo la negociaci\u00f3n, desarrollo y posterior registro del plan (art\u00edculo 5.3 del Real Decreto 901\/2020, por el que se regulan los planes de igualdad y su registro).<\/p>\n<p>No obstante lo anterior, es un hecho notorio que la respuesta de los sindicatos acostumbra a ser muy tard\u00eda (aceptan negociar pero a muchos meses vista), rechazan negociar o, incluso, no emiten ninguna respuesta a los correos y\/o burofaxes enviados.<\/p>\n<p>Esto ha generado que numerosas entidades nos formulen dudas acerca de si es posible o no que la negociaci\u00f3n se lleve a cabo formando una Comisi\u00f3n <em>ad hoc<\/em>, es decir, un comit\u00e9 formado por las personas de la propia entidad que han sido elegidas por las personas trabajadoras, y as\u00ed poder disponer del Plan de Igualdad.<\/p>\n<p>Si bien el Tribunal Supremo se pronunci\u00f3 negativamente al respecto (Sentencia del Tribunal Supremo, Sala de lo Social, Secci\u00f3n 1, Rec. 50\/2020, de 26 de enero de 2021), el Tribunal Superior de Justicia de Andaluc\u00eda, en su sentencia 180\/2023, de 25 de enero de 2023, ha aceptado recientemente la <strong>inscripci\u00f3n de un Plan de Igualdad negociado por una Comisi\u00f3n <em>ad hoc<\/em><\/strong>, puesto que la empresa hab\u00eda efectuado los requerimientos necesarios para negociar y aprobar el plan con los sindicatos y estos no contestaron en el plazo establecido por ley de diez (10) d\u00edas.<\/p>\n<p>En este caso, el Tribunal ha determinado que, para la v\u00e1lida aprobaci\u00f3n de un <a href=\"https:\/\/www.escura.com\/es\/plan-de-igualdad\/\">Plan de Igualdad<\/a> en una organizaci\u00f3n que no dispone de representaci\u00f3n legal de las personas trabajadoras, se requiere que la compa\u00f1\u00eda haya comunicado a los sindicatos <strong>su intenci\u00f3n de proceder a la negociaci\u00f3n y aprobaci\u00f3n<\/strong> del Plan de Igualdad. No obstante, si los sindicatos no responden a dicho requerimiento en el plazo establecido, la entidad puede proceder a la aprobaci\u00f3n del plan, puesto que lo que exige la normativa es dar la <strong>posibilidad<\/strong> a los sindicatos de participar en la negociaci\u00f3n, pero <strong>no de imponer<\/strong> a los mismos dicha participaci\u00f3n.<\/p>\n<p>Como bien se aclara en la sentencia, ante la falta de respuesta por parte de los sindicatos, <strong>no existe obligaci\u00f3n de remitir sucesivos requerimientos<\/strong> por parte de las entidades hasta que los mismos acepten o den respuesta para formar parte de la comisi\u00f3n negociadora (Comit\u00e9 de Igualdad), puesto que ello no se encuentra previsto ni legal ni reglamentariamente.<\/p>\n<p>As\u00ed pues, y en consonancia con todo lo expuesto, el Tribunal Superior de Justicia de Andaluc\u00eda estima que la obligaci\u00f3n de disponer del Plan de Igualdad es responsabilidad de las empresas, por lo que su elaboraci\u00f3n y aprobaci\u00f3n no puede depender de la voluntad de los sindicatos, pues con la mera falta de su respuesta es suficiente para impedir el cumplimiento de la obligaci\u00f3n legal, pudiendo conllevar sanciones de diversa \u00edndole.<\/p>\n<\/div><div class=\"fusion-separator fusion-full-width-sep\" style=\"align-self: center;margin-left: auto;margin-right:
