El objetivo de esta ley es garantizar y promover el derecho a la igualdad de trato y no discriminaci\u00f3n, respetando la igual dignidad de las personas en desarrollo de los art\u00edculos 9.2, 10 y 14 de la Constituci\u00f3n Espa\u00f1ola.<\/p>\n<p>Esta nueva ley regula los derechos y obligaciones que tienen las personas, tanto f\u00edsicas o jur\u00eddicas, p\u00fablicas o privadas; establece los principios de actuaci\u00f3n de los poderes p\u00fablicos; ampl\u00eda los colectivos que pueden sufrir discriminaci\u00f3n; y prev\u00e9 medidas destinadas a prevenir, eliminar y corregir toda forma de discriminaci\u00f3n que se pueda producir en una empresa.<\/p>\n<p>Mediante la presente circular, se destacan las novedades m\u00e1s importantes que afectan al \u00e1mbito laboral:<\/p>\n<ul>\n<li>\u00a0Ninguna empresa podr\u00e1 establecer ning\u00fan tipo de <strong>limitaci\u00f3n, segregaci\u00f3n o exclusi\u00f3n para el acceso por cuenta ajena,<\/strong> incluy\u00e9ndose los criterios de selecci\u00f3n, la formaci\u00f3n para el empleo, la promoci\u00f3n profesional, la retribuci\u00f3n, la jornada y dem\u00e1s condiciones de trabajo, as\u00ed como en la suspensi\u00f3n, despido u otras causas de extinci\u00f3n de la relaci\u00f3n laboral.<\/li>\n<li>Se proh\u00edbe expresamente por parte del empleador el preguntar sobre las <strong>condiciones de salud<\/strong> del aspirante al puesto.<\/li>\n<li>\u00a0Las empresas deber\u00e1n implementar las <strong>medidas y\/o instrumentos necesarios para poder detectar, prevenir y erradicar toda forma de discriminaci\u00f3n<\/strong> que se pueda producir en el seno de la organizaci\u00f3n. Ahora bien, la representaci\u00f3n legal de las personas trabajadoras <strong>deber\u00e1 ser informada<\/strong> de las acciones de responsabilidad social destinadas a promover las condiciones de igualdad de trato y no discriminaci\u00f3n.<\/li>\n<li>Inspecci\u00f3n de Trabajo y Seguridad Social velar\u00e1 por el respeto del derecho a la igualdad de trato y no discriminaci\u00f3n en el acceso al empleo y en las condiciones de trabajo y, para ello, incluir\u00e1 en su plan anual, el desarrollo de <strong>planes espec\u00edficos sobre igualdad de trato y no discriminaci\u00f3n.<\/strong><\/li>\n<li>\u00a0Mediante <strong>un futuro reglamento<\/strong> se establecer\u00e1 la posibilidad de exigir a los empleadores de m\u00e1s de 250 personas trabajadoras, que publiquen la informaci\u00f3n salarial necesaria para analizar los factores de diferencias salariales teniendo en cuenta las causas de discriminaci\u00f3n que establece la propia normativa.<\/li>\n<li>Todas aquellas disposiciones, actos o cl\u00e1usulas de los negocios jur\u00eddicos que constituyan o causen discriminaci\u00f3n ser\u00e1n <strong>nulos de pleno derecho.<\/strong><\/li>\n<\/ul>\n<p>Por tanto, con la entrada en vigor de la Ley 15\/2022, se ampl\u00edan los supuestos de discriminaci\u00f3n establecidos en la Ley Org\u00e1nica 3\/2007, de 22 de marzo, para la igualdad efectiva de mujeres y hombres, estableci\u00e9ndose que las empresas deber\u00e1n disponer de medidas y\/o pol\u00edticas espec\u00edficas para prevenir y eliminar cualquier tipo de discriminaci\u00f3n que se pueda producir en la organizaci\u00f3n.<\/p>\n<p>Ahora bien, en el caso de que se produzca una situaci\u00f3n de discriminaci\u00f3n en el seno de una empresa y no se hayan aplicado previamente las medidas y\/o procedimientos espec\u00edficos, la empresa responder\u00e1 del da\u00f1o causado por la conducta discriminatoria, proporcionando la indemnizaci\u00f3n correspondiente y restituyendo a la v\u00edctima a su situaci\u00f3n anterior a la conducta discriminatoria, siempre y cuando fuese posible<\/p>\n<\/div><div class=\"fusion-text fusion-text-3\"><p
