En este sentido, la entidad decidi\u00f3 proceder al despido disciplinario ante la gravedad de los hechos comunicados.<\/p>\n<p>Debe destacarse que la entidad ampar\u00f3 el despido en lo recogido en el art\u00edculo 54.2 del Estatuto de los Trabajadores, concretamente en base a los siguientes motivos \u201ctransgresi\u00f3n de la buena fe contractual y el quebranto de la confianza inherente a la relaci\u00f3n laboral en un servicio sanitario; ofensa a la dignidad de la paciente mediante actuaciones corporalmente invasivas y comentarios impropios en un contexto terap\u00e9utico; y en cuanto la conducta se proyecta como incumplimiento grave y culpable que compromete la seguridad y confianza exigibles en la prestaci\u00f3n asistencial\u201d, cumpliendo en todo caso con los requisitos formales del despido disciplinario.<\/p>\n<p>Posteriormente, la persona trabajadora impugn\u00f3 el despido alegando que la entidad omiti\u00f3 el tr\u00e1mite interno de informaci\u00f3n y audiencia previsto en el C\u00f3digo \u00c9tico y de Conducta, as\u00ed como en los canales de conducta y gesti\u00f3n de reclamaciones. No obstante, del contenido de estos instrumentos <strong>no<\/strong> se puede afirmar la existencia de dicho tr\u00e1mite con anterioridad al despido disciplinario. En este sentido, se excluye expresamente del \u00e1mbito de aplicaci\u00f3n de dichos instrumentos las cuestiones de \u00edndole laboral y de recursos humanos, debi\u00e9ndose seguir en estos supuestos los cauces ordinarios.<\/p>\n<p>Por tanto, el Tribunal ha llegado a la conclusi\u00f3n de que la entidad actu\u00f3 de manera diligente, sin poder atribuir al C\u00f3digo \u00c9tico y al Canal de Denuncias la fuerza para invalidar un despido, dictaminando dicho Tribunal que estos instrumentos no pueden ser una barrera en el momento en el que las entidades decidan ejercer su potestad sancionadora cuando alguna persona trabajadora comete faltas muy graves.<\/p>\n<\/div><div class=\"fusion-text fusion-text-4\"><p>\u00a9 La presente informaci\u00f3n es propiedad de <a
