La duda habitual surge cuando el trabajador se encuentra en <strong>situaci\u00f3n de incapacidad temporal (IT)<\/strong> prolongada: \u00bfpuede la empresa reducir o suprimir este complemento sin incurrir en trato discriminatorio?<\/p>\n<p>La reciente <strong>sentencia de la Audiencia Nacional (SAN) n.\u00ba 78\/2025, de 3 de junio<\/strong>, ha abordado este asunto con claridad, estableciendo que <strong>no existe discriminaci\u00f3n por raz\u00f3n de discapacidad<\/strong> cuando se ajusta el bonus proporcionalmente a la prestaci\u00f3n real de servicios. Esta resoluci\u00f3n sienta un importante criterio para empresas que gestionan retribuciones variables en casos de ausencias prolongadas por enfermedad.<\/p>\n<p><strong><u>\u00bfQu\u00e9 dice exactamente la sentencia?<\/u><\/strong><\/p>\n<p>Se trata de un trabajador con una baja de larga duraci\u00f3n por IT que impugna la reducci\u00f3n de su bonus, argumentando que constituye una discriminaci\u00f3n indirecta por raz\u00f3n de discapacidad, al haber cobrado una cantidad inferior al resto de compa\u00f1eros en igual puesto.<\/p>\n<p>La Audiencia Nacional desestima la demanda y concluye que <strong>la diferencia en la retribuci\u00f3n variable no es discriminatoria,<\/strong> ya que el bonus est\u00e1 vinculado a objetivos o resultados derivados del trabajo efectivo.<\/p>\n<p><strong><u>Claves de la resoluci\u00f3n<\/u><\/strong><\/p>\n<ol>\n<li><strong>Proporcionalidad leg\u00edtima. <\/strong>La empresa no suprime el bonus, sino que lo <strong>reduce proporcionalmente<\/strong> al tiempo efectivamente trabajado. No se penaliza la enfermedad, sino que se retribuye \u00fanicamente el rendimiento real.<\/li>\n<li><strong>No vulneraci\u00f3n del derecho a la igualdad <\/strong>No hay discriminaci\u00f3n porque <strong>todos los trabajadores son tratados del mismo modo<\/strong>: perciben el bonus en proporci\u00f3n a su dedicaci\u00f3n efectiva. Se descarta cualquier trato peyorativo por raz\u00f3n de salud o discapacidad.<\/li>\n<li><strong>Naturaleza del bonus. <\/strong>El sistema de retribuci\u00f3n variable est\u00e1 concebido como <strong>incentivo vinculado a objetivos,<\/strong> no como parte fija del salario ni como derecho autom\u00e1tico por mera pertenencia a la plantilla. Solo se devenga si hay prestaci\u00f3n de servicios.<\/li>\n<li><strong>Coherencia con doctrina previa. <\/strong>La sentencia se alinea con la jurisprudencia del TJUE, del Tribunal Supremo y del TC, que permiten ciertos tratos diferenciales <strong>si est\u00e1n justificados, son proporcionales y no est\u00e1n basados en razones prohibidas por la ley.<\/strong><\/li>\n<\/ol>\n<p><strong><u>\u00bfC\u00f3mo debe actuar la empresa?<\/u><\/strong><\/p>\n<ul>\n<li><strong>Revisar contratos y pol\u00edticas retributivas. <\/strong>Aseg\u00farese de que el sistema de bonus est\u00e1 claramente definido como compensaci\u00f3n por objetivos vinculados al trabajo efectivo. Evite f\u00f3rmulas ambiguas.<\/li>\n<li><strong>Aplicar criterios objetivos y uniformes.\u00a0 <\/strong>Reduzca proporcionalmente seg\u00fan d\u00edas trabajados, sin introducir excepciones arbitrarias o tratamientos diferenciados injustificados.<\/li>\n<li><strong>Documentar y comunicar con transparencia. <\/strong>Informe al trabajador de forma clara sobre el motivo del ajuste del bonus. Esto ayuda a prevenir conflictos y refuerza la defensa ante una eventual impugnaci\u00f3n.<\/li>\n<\/ul>\n<p><strong>Atenci\u00f3n.<\/strong> Es <strong>l\u00edcito reducir el bonus<\/strong> si existe una IT de larga duraci\u00f3n, siempre que el sistema retributivo est\u00e9 vinculado al rendimiento y se aplique el criterio de proporcionalidad.
