class=\"fusion-text fusion-text-2\"><p>Desde el 7 de marzo de 2022, <strong>todas las empresas que tengan 50 o m\u00e1s personas trabajadoras tienen que disponer de un Plan de Igualdad pactado con la representaci\u00f3n legal de las personas trabajadoras<\/strong> o, en su defecto, con la representaci\u00f3n sindical, en el cual se incluyan medidas dirigidas a garantizar el principio de igualdad de trato y oportunidades y a evitar cualquier tipo de discriminaci\u00f3n laboral entre mujeres y hombres.<\/p>\n<p>Tendr\u00e1 que registrarse en el Registro y Dep\u00f3sito de Convenios Colectivos, Acuerdos Colectivos de Trabajo y Planes de Igualdad (REGCON)\u00a0y ser aprobado por la autoridad laboral correspondiente.<\/p>\n<p>Una vez registrado, las medidas para conseguir la igualdad efectiva tendr\u00e1n que implantarse seg\u00fan lo establecido en el calendario de actuaciones del propio Plan mediante las diversas reuniones del Comit\u00e9 de Igualdad (Comisi\u00f3n de vigilancia y seguimiento del Plan) y someterse a una evaluaci\u00f3n peri\u00f3dica.<\/p>\n<div class=\"contenedor-tabla borderh1\"><\/div>\n<\/div><div class=\"fusion-text fusion-text-3\"><p>En Escura disponemos situaci\u00f3n, para conseguir en la empresa la igualdad de trato y de oportunidades entre mujeres y hombres y a eliminar la discriminaci\u00f3n por raz\u00f3n de sexo.<\/p>\n<\/div><\/div><\/div><div supuestos de empresas que se encuentren obligadas a implantar un Plan de Igualdad:<\/p>\n<ul>\n<li>Empresas que tengan 50 o m\u00e1s personas trabajadoras.<\/li>\n<li>Empresas que por su convenio colectivo se establezca tal obligaci\u00f3n.<\/li>\n<li>Empresas que hubieran acordado con la autoridad laboral la sustituci\u00f3n de sanciones por la elaboraci\u00f3n del Plan de Igualdad.<\/li>\n<\/ul>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-4cc7ae85d19787cc5 fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" fusion-clearfix\">\n<p>De conformidad con el art\u00edculo 46 de la Ley Org\u00e1nica 3\/2007, de 22 de marzo, para la igualdad efectiva de mujeres y hombres, los planes de igualdad, as\u00ed como el diagn\u00f3stico de la situaci\u00f3n, tendr\u00e1n que contener, al menos, las siguientes materias:<\/p>\n<ol>\n<li>Proceso de selecci\u00f3n y contrataci\u00f3n.<\/li>\n<li>Clasificaci\u00f3n profesional.<\/li>\n<li>Formaci\u00f3n.<\/li>\n<li>Promoci\u00f3n profesional.<\/li>\n<li>Condiciones de trabajo, incluida la auditor\u00eda salarial entre mujeres y hombres.<\/li>\n<li>Ejercicio corresponsable de los derechos de la vida personal, familiar y laboral.<\/li>\n<li>Infrarrepresentaci\u00f3n femenina.<\/li>\n<li>Retribuciones.<\/li>\n<li>Prevenci\u00f3n del acoso sexual y por raz\u00f3n de sexo.<\/li>\n<\/ol>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-d5b8e50fe2789a6ea fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title negociarse?<\/span><\/a><\/h4><\/div><div id=\"d5b8e50fe2789a6ea\" class=\"panel-collapse collapse \" aria-labelledby=\"toggle_d5b8e50fe2789a6ea\"><div class=\"panel-body toggle-content fusion-clearfix\">\n<p>En virtud del art\u00edculo 5 del Real Decreto 901\/2020, por el cual se regulan los planes de igualdad y su registro, para la negociaci\u00f3n y aprobaci\u00f3n del Plan, se constituir\u00e1 una comisi\u00f3n negociadora en la cual tendr\u00e1n que participar de manera paritaria la representaci\u00f3n de la empresa y la de las personas trabajadoras (comit\u00e9 de empresa o delegados\/as de personal).<\/p>\n<p>Ahora bien, en aquellas empresas que no dispongan de representaci\u00f3n legal de las personas trabajadoras, es imperativo constituir una comisi\u00f3n negociadora constituida por la representaci\u00f3n de la empresa y, de otro lado, por una representaci\u00f3n de las personas trabajadoras, integrada por los sindicatos m\u00e1s representativos y por los sindicatos representativos del sector al cual pertenezca la empresa y con legitimaci\u00f3n para formar parte de la comisi\u00f3n negociadora del convenio colectivo de aplicaci\u00f3n.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default panel-59b2a71043f2054f0 fusion-toggle-has-divider\"><div class=\"panel-heading\"><h4 class=\"panel-title toggle\" id=\"toggle_59b2a71043f2054f0\"><a aria-expanded=\"false\" aria-controls=\"59b2a71043f2054f0\" role=\"button\" data-toggle=\"collapse\" data-parent=\"#accordion-32320-1\" fusion-clearfix\">\n<p>El Plan de Igualdad entrar\u00e1 en vigor en su fecha de aprobaci\u00f3n y su duraci\u00f3n se extender\u00e1 hasta un plazo m\u00e1ximo de cuatro a\u00f1os, sin perjuicio de que su contenido sea sometido a revisi\u00f3n, siempre que concurran las circunstancias previstas en el propio documento.<\/p>\n<\/div><\/div><\/div><div class=\"fusion-panel panel-default fases:<\/p>\n<ul>\n<li>Fase 1: Constituci\u00f3n de la Comisi\u00f3n Negociadora o Comit\u00e9 de Igualdad.<\/li>\n<li>Fase 2: An\u00e1lisis de la situaci\u00f3n de la empresa en materia de igualdad mediante el diagn\u00f3stico de la situaci\u00f3n.<\/li>\n<li>Fase 3: Elaboraci\u00f3n y aprobaci\u00f3n del Plan de Igualdad por parte de la empresa y la representaci\u00f3n social.<\/li>\n<li>Fase 4: Registro del Plan de Igualdad en la plataforma del REGCON (Registro y Dep\u00f3sito de Convenios Colectivos, Acuerdos Colectivos de Trabajo y Planes de Igualdad).<\/li>\n<\/ul>\n<p><img toggle-content fusion-clearfix\">\n<p>Seg\u00fan lo dispuesto en el Real Decreto Legislativo 5\/2000, de 4 de agosto, por el cual se aprueba el texto refundido de la Ley sobre Infracciones y Sanciones en la Orden Social (LISOS), aquellas empresas que incumplan con la obligaci\u00f3n de elaborar y aprobar un Plan de Igualdad incurrir\u00e1n en una infracci\u00f3n grave o muy grave y ser\u00e1n
