{"id":28232,"date":"2021-09-29T16:03:23","date_gmt":"2021-09-29T14:03:23","guid":{"rendered":"https:\/\/blog.escura.com\/?p=18807"},"modified":"2022-02-04T12:44:22","modified_gmt":"2022-02-04T11:44:22","slug":"extension-rights-in-matters-of-guarantees","status":"publish","type":"post","link":"https:\/\/www.escura.com\/en\/extension-rights-in-matters-of-guarantees\/","title":{"rendered":"Extension rights in matters of Guarantees"},"content":{"rendered":"<h3 style=\"text-align: right;\"><a href=\"http:\/\/www.escura.com\/wp-content\/uploads\/2021\/09\/47-21-extension-rights-in-guarantees.pdf\">View the PDF<\/a><\/h3>\n<p><img decoding=\"async\" class=\"alignleft size-thumbnail wp-image-16259\" src=\"http:\/\/www.escura.com\/wp-content\/uploads\/2019\/01\/CC0-302-1-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" \/>The \u201cReal Decreto Ley 7\/2021\u201d, of 27<sup>th<\/sup> April transposes two EU directives that affect the General Law for the Defence of Consumers and Users, which extend rights regarding guarantees.<\/p>\n<p>Article 16\u00ba of the \u201cRDL 7\/2021\u201d makes a series of amendments to the current consumers and users\u2019 legislation, the General Law for the Defence of Consumers and Users, among which, <strong>in relation to sale of goods contracts<\/strong>, the following should be highlighted:<\/p>\n<p>(i) Compliance with the contract is now determined by the fulfilment of <strong>objective and subjective requirements<\/strong>, including the installation. The consumer is able to demand compliance of the contract through repair or replacement, and if these remedies were not effective, a reduction of the price or termination of the contract shall proceed. In any of these cases, the consumer or user may also require, in addition, compensation for damages, if applicable.<\/p>\n<p>(ii) The <strong>legal warranty period is increased from 2 to 3 years<\/strong> from the time of delivery of the goods.<\/p>\n<p>In second-hand goods, the businessman and the consumer or user may agree on a shorter period, which may not be less than 1 year from delivery.<\/p>\n<p>(iii) The presumption of <strong>lack of conformity<\/strong>, unless proven otherwise, is increased <strong>from 6 months to 2<\/strong><\/p>\n<p><strong>years <\/strong>following delivery of the goods.<\/p>\n<p>(iv) In the event of repair of the good due to lack of conformity, the businessman is liable for that repaired good during the year after the delivery of it.<\/p>\n<p>(v) The <strong>action to claim<\/strong> compliance with non-conformities <strong>is increased from 3 to 5 years<\/strong> from the manifestation of the lack of conformity.<\/p>\n<p>(vi) The manufacturer must guarantee, in any case, the <strong>existence of an adequate technical service, as well as for spare parts<\/strong> for a minimum period of <strong>10 years<\/strong> from the date the good stops being manufactured.
